NL CIVIL LAW / NL NAUTICA
Legal support for
life on the water.
For leisure boaters, at sea and on the lakes. An accident, a disputed insurance policy, a problem with a boatyard or a purchased boat: we help you assess the facts, the documents and the available options.
First the facts. Then the course.
We start with what happened and what you want to achieve. We organise the chronology, the available evidence, the policy and the parties’ commitments. Where needed, an independent technical expert helps distinguish the physical problem from the legal issues.
We then assess liability, alternatives, timing and costs in relation to the practical value of the outcome. A documented claim, negotiation or court proceedings: the strategy follows the assessment.
An initial conversation.
Briefly tell us what happened, when and who is involved. Mention any deadlines or steps already taken. Before receiving confidential documents, we check whether the firm can assist you.
Depending on the case, the contract, policy, photographs, quotations, expert reports and correspondence will be the starting point. We can meet at our Milan office, by phone or by video call.
Boating accidents
A collision, an impact while manoeuvring or an injury on board. We reconstruct the incident, identify the parties involved and assess the relationship between damage, liability and insurance cover.
Photographs, witness accounts and technical documents help compare conflicting versions of events and provide a basis for discussions with the other parties.
Boat insurance
Has the insurer denied cover, relied on an exclusion or offered an amount that does not reflect the damage? We examine the policy, claim notification, expert reports and correspondence, distinguishing cover for the boat from third-party liability.
We assess the grounds for the dispute and the appropriate steps: a reasoned claim, discussions with the insurer, negotiation or litigation.
Boat and boatyard
Damage during storage or lifting, defective work, disputed charges and delayed delivery. We compare agreements, quotations, the condition of the boat and the work carried out.
The assessment also covers custody and mooring: who held the boat, what obligations they had undertaken and what evidence supports the damage claim.
Boat purchases and defects
A used boat’s engine has a defect, the hull differs from its description or promised documents are missing. We review the contract, advertisement, correspondence and technical findings to frame the claim.
We can also assist before a purchase, clarifying terms, warranties and matters to check before you commit.
